Illegal Gratification III

Devasagayam, from Railways, lodged a complaint on 29.10.2015, alleging payment of Rs.2,60,000/-. When a refund was demanded, Devasagayam did not get it.  

It appears, Devasagayam originally had a genuine grievance. But, later turned out to be a Trojan horse, willing to sabotage investigation against influential persons.

It is true, English is not our mother tongue. It is also true, some allowance (or discount ranging from 0 to 90%) can be given at times to use of certain loose expressions. Order, dated 31.10.2022, of Madras High Court in Criminal O.P. No. 15122 of 2021 does not reflect a mere deficiency in language or law. There is something more. It has not merely opened up a small loophole but a black hole.   

Order, dated 31.10.2022, of Madras High Court in Criminal O.P. No. 15122 of 2021 shall stand dismissed.

Interestingly, Sh. Singhvi equated ‘approvers’ to ‘Trojan horses’ and ‘Jaichands’. Court wonders, if Learned Senior Counsel terms ‘approvers’ as ‘Jaichands’, it would amount to saying ‘approvers’ have turned ‘traitors’ and further acknowledging they were part of same alleged plan which Directorate of Enforcement alleges ‘approver’ and A. Kejriwal were part of.
