In 2006, the marriage of the Appellant-Wife and the Respondent-Husband was solemnized. In 2009, Master Krishav Gautam was born. In 2012, Respondent-Husband filed for divorce. The Trial Court directed that Master Krishav Gautam should be admitted in Col. Satsangi’s Kiran Memorial Public School, New Delhi.
Learned Counsel submitted that the boy is not willing to study in the Col. Satsangi’s Kiran Memorial Public School, New Delhi and intends to study in his old school: Global International School, Shahjanpur. Accordingly, he was admitted. It is not in dispute that the boy, aged 10, was earlier studying in the same school. Supreme Court interacted with the boy.
“We are of the view that in the interest of the welfare of the child, he cannot be compelled to admit in Col. Satsangi’s Kiran Memorial Public School, New Delhi.”
