Strict Construction of Election Law II

Rule 7 of The Madras High Court Election Petitions Rules, 1967 mandated, every Election Petition shall be presented by Petitioner in person before II Assistant Registrar, Original Side, High Court or, in his absence, before such Officer of Court as Registrar of High Court may direct.

Approaching the present controversy through the lens of Jamal Uddin Ahmad v. Abu Saleh Najmuddin, (2003) 4 SCC 257, Rule 7 of The Madras High Court Election Petitions Rules, 1967 cannot be said to have travelled beyond the statutory scheme of Section 81 of The Representation of the People Act, 1951.
