Although Mihir and Vidushi’s marriage was solemnised in India at Kolkata, most times prior to marriage and post marriage, they resided at 14 Academy Gardens, Duchess of Bedford’s Walk, Kensington, London W8 7QQ, UK. The proceedings initiated by Vidushi before English Court were founded on substantial connecting factors.

One factor which should dissuade Court from granting an anti-suit injunction is, proceedings before Foreign Court, which are sought to be interjected, are yet to conclude. When Alipore Trial Court granted anti-suit injunction ignoring this factual aspect that proceedings at UK Family Court had not concluded, it committed a patent error.
