Fourth Prof. N.R. Madhava Menon SAARCLAW Mooting Competition [India Round], 2018-19

The Chief Guest at the Inaugural Function on 27.10.2018 was Hon’ble Justice Rajendra Menon, Chief Justice, Del HC. The Chief Guest at the Valedictory Function on 28.10.2018 was Hon’ble Justice R.K. Agrawal, Former SC Judge and President, NCDRC.

The ‘Moot Proposition’ was drafted by Mr. Ravi Prakash, Advocate, Supreme Court of India.

The Proposition [Abridged]

The Constitution of Indica establishes The Supreme Court of Indica. The legal framework of Republic of Indica are pari materia to the Republic of India.

The Government of A&P formulated a Covert Operation Policy. The Police Authority placed 2 Police Officers in a Drug Syndicate, Little Blue Fancy. New Government in A&P abandoned the Covert Operation. Evidence, extensive and elaborate, was shared with Central Bureau of Investigation.

X is a resident of District Satna. An 8-Year-Old was raped near X’s School in Village Rusul, Satna. The victim succumbed to injuries. CBI found that one of the DNA samples collected matched a DNA sample collected during the Covert Operation. The CBI arrested X. X filed a Writ Petition under Article 32. ‘Search and Seizure’ during the Covert Operation was pleaded to be without Authority of Law.

Indica faced a severe calamity. Master Z lost his immediate family. Technology for All & Justice [TAJ] approached the Supreme Court seeking Guidelines for DNA Technology in Disaster Victim Identification. X claimed to be the Biological Father of Z. Z sought to protect his Right to Reputation and Dignity [Board of Trustees, (1983) 1 SCC 124; Vishwanath Agrawal, (2012) 7 SCC 288; Mehmood Nayyar, (2012) 8 SCC 1; Umesh Kumar, (2013) 10 SCC 591]. Z contended that his familial affinity should remain undisclosed.

The Mooting Competition was immaculately organized by The Lloyd Law College, Greater Noida. The Judges were awarded books, souvenirs, notes of acknowledgment and a beautiful memento. Best of Luck!
