5 Lakhs for Supreme Court II

Himanshu Kumar claims to be running an NGO: Vanvasi Chetna Ashram. Himanshu’s Writ Petition relates to an alleged massacre on 17th September, 2009 and 1st October, 2009 in Gachhanpalli, Gompad and Belpocha situated in District of Dantewada, State of Chhattisgarh.

An aggrieved person can only claim, offence he alleges be investigated properly. But, he has no right to claim, it be investigated by any particular agency of his choice [Romila Thapar v. Union of India, (2018) 10 SCC 753].  

We are of view, having regard to materials on record, no case, worth further investigation or re-investigation, could be said to have been made out. There is not an iota of material, figuring in investigation, on basis of which even a finger can be pointed.

Not once in last 12 years any grievance has been made either orally or in writing before this Court as regards mode and manner of recording of statements. It is too late to cast any insinuations or aspersions.

Himanshu’s Writ Petition is hereby rejected with exemplary costs of Rs. 5,00,000/- [Rupees Five Lakhs].
